Student Information

Research topic:

In 2002, the Peruvian government enacted the law 27811 devoted to "the protection of indigenous traditional knowledge associated with biological resources. " This was based on the 1992 Convention on Biological Diversity in which traditional knowledge protection related to biological resources is regarded under an intellectual property rights perspective. Focusing mostly on contracts about genetic resources, the Colombian government established legal regulation of traditional knowledge under several different laws. My doctoral research aims to analyse this legislation in the case of traditional knowledge related to medicinal plants by considering, on the one hand, the legal tools implemented to protect traditional knowledge and fight "biopiracy" and, on the other, the role played by different actors: States, indigenous communities, pharmaceutical companies, public and private institutions and scientific communities.

Key words: Medicinal plants, intellectual property rights, traditional knowledge.
